1. Agreement to Terms

By accessing or using the website neuromotiv.com or booking any service with Neuromotiv ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

These Terms apply to all visitors, clients, and anyone who accesses or uses our website or services.

2. About Our Services

Neuromotiv offers neurocentric movement coaching, brain-based training, Taijiquan instruction, and related wellness education services ("Services"). Our Services are designed to support movement, performance, balance, pain management, and overall well-being through brain-based practices.

Important Disclaimer: Neuromotiv is a coaching and movement education practice. We are not a medical, clinical, psychiatric, or therapeutic provider. Our Services do not constitute medical advice, diagnosis, or treatment. Nothing shared during coaching sessions or on this website should be interpreted as a substitute for professional medical care. Always consult a qualified healthcare provider before beginning any new movement or wellness program, particularly if you have existing health conditions or injuries.

3. Eligibility

By using our Services, you represent that:

• You are at least 18 years of age, or have the consent of a parent or legal guardian

• You have the legal capacity to enter into a binding agreement

• You will use our Services only for lawful purposes

4. Appointments and Scheduling

Booking: Appointments are scheduled through Acuity Scheduling. By booking an appointment, you agree to Acuity's Terms of Service in addition to these Terms.

Cancellations and Rescheduling: We require at least 24 hours notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours notice may be subject to a cancellation fee or forfeiture of the session. We reserve the right to update our cancellation policy at any time.

Late Arrivals: If you arrive late to a session, we will do our best to accommodate you within the remaining scheduled time. Sessions will not automatically be extended beyond the scheduled end time.

No-Shows: Missed appointments without prior notice may be charged the full session rate.

5. Payment

Payment terms and fees are established at the time of booking or as outlined in any separate service agreement between you and Neuromotiv. All fees are due as agreed. We reserve the right to update our pricing at any time, with changes taking effect for future bookings.

If you believe a charge is incorrect, please contact us within 30 days of the charge at neuromotiv@gmail.com.

6. Health and Physical Activity Assumption of Risk

Participation in movement-based coaching and physical training involves inherent risks, including but not limited to physical injury, muscle soreness, fatigue, or aggravation of existing conditions.

By participating in our Services, you:

• Acknowledge and accept these inherent risks

• Represent that you are physically able to participate in movement-based activities

• Agree to inform your coach of any injuries, health conditions, or physical limitations prior to beginning any session

• Agree that Neuromotiv, its coaches, and representatives are not liable for injury, illness, or adverse outcomes resulting from participation in our Services

This assumption of risk does not limit your right to receive coaching that is appropriate and reasonably safe for your disclosed condition.

7. Client Responsibilities

You agree to:

• Provide accurate and complete health and wellness information during intake and throughout your coaching relationship

• Communicate openly with your coach about any changes to your health or physical condition

• Follow any pre-session instructions provided

• Treat coaches, staff, and other clients with respect

• Use the information, materials, and techniques shared in sessions responsibly and appropriately

8. Intellectual Property

All content on neuromotiv.com, including text, images, videos, logos, session materials, and program content, is the property of Neuromotiv and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on our website or shared in sessions without our prior written permission.

9. Confidentiality

We treat information you share in coaching sessions as confidential. We will not disclose your personal or health information to third parties except as described in our Privacy Policy or as required by law.

We ask that you also treat information shared by your coach, other clients, or within any group sessions as confidential.

10. Communications

By contacting us or booking an appointment, you consent to receive communications from Neuromotiv related to your sessions, account, and services. Standard message and data rates may apply for text communications. You may opt out of non-essential communications at any time by contacting us at neuromotiv@gmail.com.

11. Website Use

You agree to use neuromotiv.com only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site. You may not:

• Use the site in any way that violates applicable laws or regulations

• Attempt to gain unauthorized access to any part of the website or its systems

• Transmit any harmful, offensive, or disruptive content through the site

• Use automated tools to scrape, crawl, or extract data from the site

12. Third-Party Links and Services

Our website and services involve third-party platforms including Wix, Acuity Scheduling, and Google Workspace. We are not responsible for the content, practices, or terms of third-party services. Your use of those platforms is governed by their own terms and policies.

13. Limitation of Liability

To the fullest extent permitted by law, Neuromotiv, its owners, coaches, and staff shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services or website, including but not limited to physical injury, loss of data, or financial loss.

Our total liability for any claim arising from our Services shall not exceed the amount you paid us for Services in the 30 days preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Neuromotiv, its owners, coaches, and staff from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of another party.

15. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in La Plata County, Colorado.

16. Dispute Resolution

We encourage you to contact us first at neuromotiv@gmail.com if you have any concerns or disputes. We will make a good-faith effort to resolve any issues directly before either party pursues formal legal action.

17. Changes to These Terms

We may update these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or Services after any changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy and any separate service agreements, constitute the entire agreement between you and Neuromotiv regarding your use of our Services.
